1. Agreement
These Terms of Use (“Terms”) apply to the FUNKY BEATS LTD website and to the Pace Trainer Android application (“Pace Trainer” or the “app”). By accessing the website or installing or using the app, you agree to these Terms. If you do not agree, do not use them.
“We”, “us” and “our” mean FUNKY BEATS LTD. “You” means the person using the website or app.
2. Eligibility
Pace Trainer is intended for people aged 13 and over. If the law where you live requires a parent or guardian to approve your use, you must have that approval.
3. Licence to use Pace Trainer
Subject to these Terms and the applicable app-store rules, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use Pace Trainer on compatible devices for your own lawful, non-commercial practice.
You do not receive ownership of the app, its passages, interface, branding or other content.
4. Acceptable use
You may use the website and app only lawfully. You must not:
- Copy, resell, redistribute or commercially exploit the app or its passage library except where applicable law expressly permits it;
- Attempt to bypass security, interfere with normal operation or introduce harmful code;
- Reverse engineer, decompile or disassemble the app except to the limited extent this cannot lawfully be restricted;
- Misrepresent Pace Trainer’s timing estimates as a professional assessment or certification; or
- Use the app in a way that infringes another person’s rights or breaks the law.
5. Timing estimates and coaching notes
Words-per-minute figures are estimates calculated from passage length and reading time. They describe speed only. They do not measure or assess pronunciation, fluency, comprehension, language ability, speech quality or fitness for any purpose.
Prompts and coaching notes are general practice suggestions, not personalised teaching, medical advice, speech therapy or professional certification. Do not rely on Pace Trainer for diagnosis or treatment. Seek an appropriately qualified professional where needed.
6. Your recordings and device data
You choose whether to record and save a voice take. Your recordings and practice data stay on your device and remain under your control. You are responsible for keeping your device secure and for ensuring you have any permission required before recording another person’s voice.
FUNKY BEATS LTD does not receive or back up app recordings and cannot recover them if they are deleted, lost or inaccessible.
7. Safe use
Use Pace Trainer in a safe setting. Do not read from or interact with the app while driving, cycling, operating machinery or doing anything that requires your full attention. Stop a practice session if speaking causes discomfort or strain.
8. Intellectual property
Pace Trainer, its design, branding, software and original reading passages are owned by or licensed to FUNKY BEATS LTD and are protected by intellectual-property laws.
The app also uses open-source fonts and icons under their respective licences, including Fredoka and Nunito under the SIL Open Font License 1.1 and Tabler Icons under the MIT License. Applicable licence texts are supplied in the app package.
9. App-store services, compatibility and changes
Your download and use may also be subject to Google Play terms. Google is not responsible for providing Pace Trainer support unless its terms say otherwise.
We may update, improve, suspend or discontinue any part of the website or app. Device, Android-version or app-store changes may affect compatibility. We do not promise uninterrupted or error-free availability.
10. Disclaimers
To the fullest extent the law permits, the website and app are provided “as is” and “as available”, without warranties or promises that they will meet every requirement, achieve a particular result or always be accurate, available or error-free.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
11. Limitation of liability
Nothing in these Terms limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to that, and to the fullest extent permitted by law, FUNKY BEATS LTD will not be liable for indirect or consequential loss, loss of data, loss of opportunity or loss caused by relying on timing estimates or general practice suggestions. If you are a consumer, these Terms do not affect your mandatory legal rights.
12. Termination
You may stop using Pace Trainer at any time and uninstall it. We may end the licence if you materially breach these Terms. Provisions that by their nature should continue after termination, including ownership, disclaimers and liability limits, will continue.
13. Changes to these Terms
We may revise these Terms to reflect changes to the product, law or our operations. The updated date will appear on this page. Continuing to use the app after a material update takes effect means you accept the revised Terms where applicable law allows.
14. Governing law
Unless mandatory consumer law requires otherwise, these Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction. If you are a consumer, you may also have the right to bring a claim in the courts where you live.
